1. GENERAL PROVISIONS
1.1.These Terms and Conditions of Purchase and Sale (hereinafter referred to as the "Terms and Conditions") set out the rights, obligations and responsibilities between the person purchasing goods Saffort.lt in the online shop (hereinafter referred to as the "Buyer") and SAFFORT NORTHERN EUROPE UAB (hereinafter referred to as the "Seller") in relation to the purchase of goods by the Buyer in the online shop. By purchasing goods in the online shop, the Buyer agrees to the application of these Terms and Conditions.
1.2 The Seller reserves the right to change, amend or supplement the Terms and Conditions at any time, taking into account the statutory requirements.
2. MOMENT OF CONCLUSION OF THE SALE AND PURCHASE AGREEMENT
2.1 The Purchase and Sale Contract between the Buyer and the Seller shall be deemed to have been concluded as soon as the Buyer, after having created a shopping cart in the online shop, indicated the delivery address, chosen the payment method and read these Terms and Conditions, clicks on the confirmation button, thus placing and confirming his/her order, and shall remain in force until the full performance of his/her obligations under the present contract. If the Buyer does not accept all or part of the Terms and Conditions, the Buyer shall not place the order.
3. RIGHTS OF THE BUYER
3.1 The Buyer shall have the right to purchase goods in the e-shop in accordance with these Terms and Conditions and the legislation of the Republic of Lithuania.
3.2 The Buyer shall have the right, without giving any reason, to withdraw from the contract of sale and purchase of goods concluded in the online shop with the Seller (except for the exceptions set out in this section below) by notifying the Seller not later than 30 days from the date of delivery of goods.
3.3 The Buyer's right to withdraw from the contract for the purchase and sale of goods concluded in the online shop with the Seller shall not apply to the following contracts:
3.3.1. contracts for goods manufactured or assembled according to the User's special instructions, which are not pre-manufactured or assembled and which are manufactured according to the User's personal choice.
3.3.2. for contracts for goods ordered to the specific order of the User, i.e. goods which are not held in the Seller's warehouse (all goods with a delivery period of more than 2 days) and which are only delivered upon the Buyer's specific order.
3.4 The Buyer shall be entitled to return the Goods to the Seller for a full refund of the price paid for the Goods when:
3.4.1. not more than 30 days have elapsed from the date of delivery.
3.4.2. the Goods are not damaged or otherwise affected by external factors.
3.4.3. the Goods are returned in their original packaging as delivered to the Buyer.
3.5 If the Buyer decides to return the Goods, the Buyer must complete a free-form returns form, in which the Buyer must provide his/her personal details - name, address and order number, the reason for the return and submit it to the Seller.
3.6 In the case of a free return, the Buyer shall be responsible for the delivery of the goods to the Seller and the costs involved.
3.7 In the case of a free return, the Buyer shall not be reimbursed for any additional services provided (deposit, fixing, call for a specialist, etc.).
3.8 After the return of the goods to the Seller, an expert examination of the goods shall be carried out within 15 calendar days and it shall be determined whether the goods are eligible for free return. If the Seller confirms that the Goods are undamaged and eligible for free return, the amount paid for the Goods shall be refunded to the Buyer within 15 calendar days from the time of inspection.
3.9 In the event of a return of the wrong Goods and/or faulty Goods, the Seller undertakes to accept such Goods and to replace them with similar suitable Goods or, at the Buyer's request, to refund the money paid for the Goods.
4. OBLIGATIONS OF THE BUYER
4.1 The Buyer shall pay the price of the Goods and their delivery, as well as any other payments (if any) specified at the time of conclusion of the Contract and accept the Goods ordered. The Buyer has the option to pay for the Goods in several ways: by using his/her online bank, to which a link is provided in the e-shop (if the Seller has an agreement with the Buyer's bank); by making a payment on a prepayment account; by concluding a leasing contract; by paying the full amount in cash in the shop; the Buyer also has the option to pay for the goods in cash or by bank card (American express cards are not accepted), by courier - this method is only valid for standard stock safes and not for products manufactured by the manufacturer to the Buyer's order.
4.2 If the details provided on the Buyer's registration form change, the Buyer must update them immediately.
4.3 The Buyer must confirm the payment order with the Buyer's online bank linked on the e-shop (in case the Seller has an agreement with the Buyer's bank) or make the payment from any other bank. If the Buyer pays for the Goods on the basis of a prepaid invoice, the Buyer must make the payment before the expiry of the prepaid invoice. If the Buyer fails to pay the invoice within the time specified, fails to confirm the payment order or fails to send the Seller a separate email notifying the Seller that payment has been made, the Seller shall be entitled to treat the Buyer as having abandoned the contract of purchase and sale and to cancel the order.
4.4 The Buyer shall, upon purchase of the Goods, comply with all methodological instructions of the Seller and operate the Goods strictly in accordance with the instructions for use provided. Otherwise, the Seller shall not be liable for any defects in the product, the level of safety and shall not provide any warranty of the Manufacturer.
4.5 The Buyer shall comply with all other requirements set out in the Terms and Conditions and the legislation of the Republic of Lithuania.
5. SELLER'S RIGHTS
5.1 If the Buyer attempts to interfere with the operation or stable functioning of the e-shop, the Seller may, without prior notice, restrict, suspend (terminate) the Buyer's access to the e-shop, and shall not be liable for any losses incurred by the Buyer in connection therewith.
5.2 The Seller has the right to unilaterally change these Terms and Conditions by posting them on the website of the e-shop. Amendments shall take effect from the moment of publication for all transactions entered into after publication.
5.3 The text and graphic information on the Website, which is protected under the Copyright and Related Rights Act of the Republic of Lithuania, may be copied and printed (with the exception of information belonging to third parties). However, when publishing (quoting) the content of the website or part of it, it is necessary to indicate the original source of the information (i.e. the website and the author).
5.4 The Seller shall have other rights provided for in the Terms and Conditions and the legislation of the Republic of Lithuania.
6. OBLIGATIONS AND WARRANTIES OF THE SELLER
6.1 The Seller undertakes to enable the Buyer to make proper use of the services provided by the e-shop.
6.2 The Seller undertakes to comply with the other requirements set out in these Terms and Conditions.
6.3 The Seller guarantees the quality of the goods.
7. DELIVERY OF GOODS
7.1 The Goods shall be delivered and unloaded free of charge throughout Lithuania, to the place of delivery specified by the Buyer, to the first door of the building. In the event of any vehicle access obstructions to the building or other location specified by the Buyer, the Goods shall be unloaded at the nearest location where vehicle access is possible.
7.2 A pick-up service shall be available on request by the Buyer. The drop-off service is available in Vilnius, Kaunas, Klaipėda, Šiauliai, Panevėžys and Alytus.
7.3 The Goods shall be carried from the place of unloading of the Goods to the place specified by the Buyer in the building at which the Goods have been unloaded free of charge, provided that the weight of the Goods does not exceed 30 kg.
7.3 If the weight of the Goods exceeds 30 kg, a collection service charge shall apply, which shall be determined according to the weight of the Goods and the place of delivery.
7.4 The delivery service shall be ordered separately prior to payment for the Goods and the selected services. If the Goods exceed 30 kg in weight, the Buyer shall pay for the delivery service. In individual cases specified by the Seller, the Seller shall pay for the delivery service.
7.5 The installation service for the Goods shall be ordered separately and shall not be included in the price.
7.6 At the time of delivery, the Buyer or, as the case may be, the Buyer's representative, together with a representative of the transport company, shall inspect the condition of the packaging of the consignment, the quantity, quality and range of the goods.
7.6.1 If the packaging of the consignment is found to be damaged, or the quantity, quality or assortment of the goods are not in conformity, the Buyer or, as the case may be, the Buyer's representative must not accept the consignment. In this case, a representative of the transport company, together with the Buyer or, as the case may be, the Buyer's representative, shall record the damage, take photographs of the damage and draw up a free-form damage report signed by the consignee and the representative of the transport company
7.6.2. once the Buyer or, as the case may be, the Buyer's representative has accepted the consignment and signed the data logger or paper delivery note provided by the transport company's representative without any comments, the goods shall be deemed to have been delivered in the undamaged packaging, the goods are of the same quantity, quality and range as per the terms and conditions of the contract of sale and purchase and the additional services indicated in the data logger or paper delivery note have been duly performed, unless the contrary is proven.
7.7 Upon delivery and handover of the Goods at the address specified by the Buyer, the Goods shall be deemed to have been handed over to the Buyer, whether the Goods are actually received by the Buyer or by any other person who has received the Goods at the address specified. If the goods are not delivered on the scheduled date of delivery, the Buyer shall notify the Seller immediately, but no later than the day after the scheduled date of delivery.
7.8 If the goods will be accepted by a person other than the Buyer, the Buyer must provide the details of the person who will accept the goods when completing the order delivery information.
8. LIABILITY
8.1 The Buyer is responsible for the accuracy of the data provided in the registration form. The Buyer shall be liable for the consequences of any inaccuracy or inaccuracy of the data provided in the registration form.
8.2 The parties shall be liable for the breach of the contract of purchase and sale concluded by means of the online shop in accordance with the procedure established by the legislation of the Republic of Lithuania.
8.3 The Seller shall not be liable for the information provided on the websites of other companies, even if the Buyer is directed to these websites via links on the Seller's e-shop.
8.4 The Seller shall not be liable for the fact that the colour, shape or other parameters of the goods displayed in the online shop do not correspond to the actual size, shape and colour of the goods due to the peculiarities of the display used by the Buyer.
9. PROCESSING OF PERSONAL DATA
9.1 By clicking on the order confirmation button, the Buyer confirms that he/she and his/her representatives (the Buyer shall have the consent of his/her representatives) agree to provide the Seller with his/her personal data as specified in these Terms and Conditions and in the registration form, and does not object to the processing by the Seller of the personal data provided by the Buyer and/or his/her representatives for the purpose of the online sale.
9.2 The Seller undertakes not to transfer personal data to third parties without the Buyer's consent, except in the cases provided for by the law of the Republic of Lithuania.
9.3 By clicking on the order confirmation button, the Buyer confirms that he and his representatives (the Buyer shall have the consent of his representatives) agree to present to the Seller and/or to the third party who delivers the goods on the Seller's instructions one of the personal identification documents: passport, identity card, new driving licence, in order to properly identify the Buyer and/or his representatives for the purpose of online shopping when collecting the goods. The Buyer also confirms that he and his representatives (the Buyer shall have the consent of his representatives) agree that, at the time of collection of the Goods at the place of collection, the Seller and/or the third party who has delivered the Goods on the Seller's instructions, shall take down the data of the personal identification document provided by the Buyer and/or his representatives and process such data (including, but not limited to, the transfer of the data to the Seller) for the purpose of online trading.
9.4 By clicking on the order confirmation button, the Buyer confirms that he (if the Buyer is a natural person) and his representatives have been informed of their right to have access to their personal data processed by the Seller and the manner in which they are processed, to request the rectification, destruction of their personal data or the suspension of the processing of their personal data in the case of processing that is not in compliance with the law and to oppose the processing of their personal data for any of the purposes.
9.5 By clicking on the order confirmation button, the Customer confirms that he/she and his/her representatives are aware of the right to refuse to provide his/her personal data, but understands that the personal data are necessary and indispensable for the purpose of uniquely identifying the Customer and/or his/her representatives for the purposes of online trading and that, in the event of failure to provide the personal data and/or to consent to its processing for the purpose of online trading, the Customer will not be able to enter into and/or perform the contract.
10. TRANSMISSION OF INFORMATION
10.1 The Seller shall send all communications to the email address provided by the Buyer in the registration form.
10.2 The Buyer shall send all notifications and enquiries to the address indicated in the "Contact" section of the Seller's online shop.
11. FINAL PROVISIONS
11.1 These Terms and Conditions do not limit the rights of the Buyer (consumer) as set out in the legislation of the Republic of Lithuania, including the rights in the event of the purchase of a product or service of inadequate quality.
11.2 All disputes arising out of or in connection with the contract of sale between the Buyer and the Seller shall be settled by negotiation. In the event of failure to reach an agreement, disagreements shall be settled in accordance with the procedure established by the legislation of the Republic of Lithuania.
